NOTICE OF MOTION AND MOTION FOR ORDER TO COMPEL INITIAL DEPOSITIONS OF MEDICAID RECIPIENTS
TO: PLAINTIFFS AND DEFENDANTS ABOVE-NAMED, AND THEIR ATTORNEYS.
PLEASE TAKE NOTICE that on December 5, 1995 at 9:30 a.m. or as soon thereafter as counsel may be heard, before the Honorable Kenneth J. Fitzpatrick, Ramsey County Courthouse, 15 West Kellogg Boulevard, St. Paul, Minnesota, defendants Philip Morris Incorporated, R.J. Reynolds Tobacco Company, Brown & Williamson Tobacco Corporation, B.A.T. Industries P.L.C., Lorillard Tobacco Company, The American Tobacco Company, Liggett Group, Inc., The Council For Tobacco Research - U.S.A., Inc., and The Tobacco Institute ("defendants"), will and hereby do move the Court for an order pursuant to Paragraph II(C) of the Case Management Order and Rule 37 of the Minnesota Rules of Civil Procedure authorizing defendants to take the initial depositions of between ten and twenty individual recipients of Medicaid who allegedly were treated for "smoking-related" diseases and who are current or former smokers and for an order establishing the procedure for selecting such deponents.
This motion is based on all of the pleadings, files and records herein, on the accompanying Memorandum, and upon such argument of counsel as the Court may permit. All of the defendants join in the Memorandum served and filed herewith.
